Terms & Conditions

Last updated: 22 July 2026

1. Who you are contracting with

These terms are an agreement between you and L&D Virtual Academy ("L&D Virtual Academy", "we", "us", "our"). By creating an account or continuing to use the service you agree to be bound by these terms. If you do not agree, do not use the service.

2. The service

L&D Virtual Academy provides AI-powered teaching tools, resource generation, classroom management and related features for teachers, parents and learners aligned to CAPS and IEB. We may add, change or remove features over time.

3. Your account

You must provide accurate information, keep your credentials confidential and take responsibility for activity under your account. If you are using the service on behalf of a school or organisation, you confirm you have authority to bind it. Individual users must be of legal age to enter into these terms.

4. Acceptable use

You must not:

  • use the service unlawfully or for fraud, spam or harassment;
  • infringe anyone's intellectual property or privacy rights;
  • interfere with the security of the service — for example uploading malware, probing, scraping, or circumventing technical limits;
  • reverse engineer, resell or redistribute the service; or
  • use AI features to create illegal content, hate speech, deepfakes of real people without consent, or content that exploits minors.

5. AI-generated content

You are responsible for the prompts you enter, the way you use outputs and for having the rights to any content you upload. AI outputs may be inaccurate or incomplete — please review them before using them in the classroom. Outputs are not a substitute for regulated professional advice. We may remove, filter or refuse outputs that violate these terms and may suspend accounts for repeated misuse.

6. Your content

You retain ownership of the content you upload. You grant us a limited licence to host, store and process it solely to provide the service to you. If you believe content on the platform infringes your rights, email danielleldvirtualacademy@gmail.com and we will investigate. We may remove infringing content and terminate repeat infringers.

7. Our intellectual property

The service, including its software, design, branding and documentation, is owned by L&D Virtual Academy and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with your chosen plan.

8. Payments, subscriptions and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled from your account settings.

9. Refunds

See our Refund Policy for how to request a refund.

10. Service level and warranties

We work hard to keep the service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Liability

To the fullest extent permitted by law, our aggregate liability under these terms is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence where the law does not allow such limitation.

12. Indemnity

You will indemnify us against claims arising from your content, your use of the service in breach of these terms or your unlawful use of the service.

13. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination you will have a reasonable window to export your content, after which we may delete it.

14. Governing law

These terms are governed by the laws of South Africa. Disputes will be resolved in the courts of South Africa, unless the law of your country requires otherwise.

15. Assignment and force majeure

You may not assign these terms without our consent. We may assign them as part of a merger, acquisition or reorganisation. Neither party is liable for delays caused by events beyond their reasonable control.

16. Changes

We may update these terms from time to time. Material changes will be notified through the service or by email. Continued use after changes means you accept the new terms.
